Terms & Conditions 

Please read these Terms of Service (“Agreement”, “Terms of Service”) carefully before using (“the Site”) operated by Wiz Fitness LTD (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the Site and our services at www.wizfitness.co.uk.

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. Capitalized terms are defined in this Agreement. These Terms of Service set forth the legally binding terms for your use of Wiz Fitness Services. You are only authorized to use the Wiz Fitness Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to these Terms of Service. Please read these Terms of Service carefully and save it. If you do not agree with it, you should leave the Wiz Fitness website and discontinue use of Wiz Fitness Services immediately. If you wish to become a Member or client, you must read these Terms of Service and indicate your acceptance during the registration process.


In choosing Wiz Fitness you have shown you possess the personal resolve and capability to make the positive changes in your life to achieve your fitness and nutrition goals.

TRAINERS RESPONSIBILITY
1. To support you to achieve results in your health and fitness goals.
2. Ensure all exchanges remain confidential.
3. To be accepting and understanding of your progress, your experiences and setbacks no matter what and help you rise above all that stands in the way of you achieving your goals.
4. Offer clear weekly targets and ideas to help you stay focused and motivated along the journey.

CLIENTS RESPONSIBILITY
1. To show up to every session possible
2. To always give 100% effort
3. Hold yourself accountable for the goals that have been set
4. Take responsibility for your results


CLOTHING POLICY
You must wear appropriate gym attire (i.e. shorts, sweatpants, t-shirt, tennis/running shoes, etc.) If you are not wearing suitable attire the trainer reserves the right to refuse participation in the session and no refund will be granted.

 

CLASS POLICY

The term unlimited classes per week refers to a maximum of five classes per week being taken by any Wiz Fitness member.

All classes will be conducted by Wiz Fitness at KING’S GYM Studio unless otherwise stated and last a maximum of 45 minutes.
 

PERSONAL TRAINING POLICY

All personal training sessions conducted face to face or online last a maximum of 30 or 50 minutes. All training sessions content details will be recorded on a secure cloud-based server online and progress logged by Wiz Fitness. You can request to view these records at any time.

Personal training sessions must be conducted as one-to-one (one trainer, one client) unless otherwise agreed.

Training sessions must have begun within 30 days of the date of purchase unless otherwise agreed upon. It


PERSONAL TRAINING CANCELLATION AND LATENESS POLICY

Any cancellation made must be done 24 hours before the session start time. Any request to cancel within 24 hours of the clients scheduled session will be deemed as a late cancellation. No refunds will be given for late cancellations or missed sessions and the full cost of the session will be charged.

CLASS CANCELLATION AND LATENESS POLICY
Class bookings times are reserved, and cancellations must be made a minimum of 12 hours in advance prior to the start of the scheduled class time. No refunds are issued for missed classes using block payments. If a cancellation is not made by a minimum of 12 hours prior to the scheduled class or you ‘no show’ a charge may be incurred for the class if the class was fully booked. The charge rate for continuous payment authority members is as follows, £12 for a late cancellation or a no show if the class was fully booked.
Classes will begin and end promptly as scheduled. I acknowledge that any delays to the start of a scheduled appointment due to my lateness will not result in the session being extended I understand that if I am more than 15 minutes late l will be refused entry to the class.

PAYMENT POLICY

 

PURCHASED PT BLOCK SESSIONS POLICY
Payment is due a minimum of 24 hours before the first session commences. All training sessions must be paid in full directly to Wiz Fitness prior to any participation in any training sessions.
Personal Training sessions must have begun within 30 days of the date of purchase unless otherwise agreed. and must be used within Specified days from purchase detailed below unless otherwise stated.

Blocks of 4 to be completed within 42 days of purchase
Blocks of 8 to be completed within 70 days of purchase
Blocks of 12 to be completed within 98 days of purchase

 

PURCHASED CLASS BLOCK POLICY
Blocks of 10 and 20 to be completed within 84 days of purchase


CONTINUOUS PAYMENT AUTHORITY
We will debit from your chosen debit or credit card provided your membership Fee on a 4 weekly or monthly basis automatically. The subscription price will not be increased without prior notification in writing.
All our memberships come with a minimum of a 3 month commitment with the first payment being made on the day of sign up and every 4 weeks or month thereafter.
You are obligated to make every continuous authority payment regardless of non-attendance, except where the cancellation terms below are met.

Wiz Fitness memberships are not transferable or assignable.

 

MOBILE PHONE SERVICES​

The Wiz Fitness Services may include certain services that may be available via your mobile phone, including but not limited to (i) the ability to book and/or purchase Wiz Fitness services via your mobile phone, (ii) the ability to receive and reply to Wiz Fitness messages, (iii) the ability to browse Wiz Fitness from your mobile phone and (iv) the ability to access certain Wiz Fitness features through a mobile application you have downloaded and installed on your mobile phone (collectively the “Mobile Services”). We do not charge for these Mobile Services. However, your carrier’s normal messaging, data and other rates and fees will still apply. You should check with your carrier to find out what plans are available and how much they cost. In addition, downloading, installing, or using certain Mobile Services may be prohibited or restricted by your carrier, and not all Mobile Services may work with all carriers or devices. Therefore, you should check with your carrier to find out if the Mobile Services are available for your mobile devices, and what restrictions, if any, may be applicable to your use of such Mobile Services. By using the Mobile Services, you agree that we may communicate with you regarding Wiz Fitness services and other entities by SMS, MMS, text message or other electronic means to your mobile device and that certain information about your usage of the Mobile Services may be communicated to us.

 

PASSWORD

When you sign up for member Services, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another member at any time or to disclose your password to any third party. You agree to notify Wiz Fitness immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.

 

THIRD PARTY SITES

Our Site may contain links to third-party sites that are not owned or controlled by Wiz Fitness LTD.

Wiz Fitness LTD has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

Governing law

This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of England, UK, without giving effect to any principles of conflicts of law.

 

Changes to this agreement

We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.

 

We encourage you to review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access, or continue to access the Site or discontinue any use of the Site and our services immediately.

 


CANCELLATION AND MEMBERSHIP FREEZE
1. This agreement can be cancelled if your new permanent address is more than 5 miles away from the facility upon receipt of a copy utility bill or bank statement showing the new address.
2. Long term (over 3 months) illness or injury: This agreement may be cancelled in the event of an illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for 3 months or longer upon appropriate proof being provided.
3. This agreement can be cancelled upon appropriate proof of redundancy from your employer or other loss of livelihood.
4. This agreement can be cancelled if we are in breach of contract including if we do not provide facilities or services you may reasonably expect, and we have fallen well below that standard.

 

5. This agreement may be frozen in the event of a temporary illness, injury, or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for a period of time. Please note – any Freeze will not be effected until the appropriate proof is provided and received (in writing or via email) by Wiz Fitness – A freeze period does not affect the Minimum Number of continuous Payment authority you are due to make and any payments remaining at the time of the freeze will remain due and recommence on a 4 weekly or monthly basis once the freeze period has completed.

RENEWAL POLICY
Once you have completed the minimum number of continuous authority payments, we will automatically continue collecting the Payment Amount every 4 weeks  And your membership will be extended by one month for each payment (“Renewal Period”). This renewal of the continuous payment amount may only be amended if we advise you in writing giving not less than 30-day’s notice of change and the opportunity to cancel.

You may stop the Automatic Renewal at any time by sending the cancellation notice to our email address info@wizfitness.co.uk . We require 30 day’s notice to cancel any membership with us once you have completed your initial 3-month commitment.

RELEASE OF LIABILITY
You have enrolled in a program of strenuous physical activity supervised by Wiz Fitness.

I hereby affirm that I am in the good physical condition and do not suffer from any disability that would prevent or limit my participation in this program. I fully understand that I may suffer injury as a result of my participation in the program and I hereby release Wiz Fitness any and all liability now or in the future, including but not limited to medical expenses, lost wages, pain, and suffering, that may occur by reason of heart attacks, muscle strains, pulls or tears, broken bones, shin splints, heat prostration, knee/lower back/foot injuries, and any other illness, soreness, or injury, however, caused, whether occurring during or after my participation in the program or use of the conditioning and exercise equipment and facilities, regardless of fault.

Wiz Fitness has the right and the authority to terminate the agreement at any time, with no refund, if a client does not follow the program with specific requirements and where a commitment to a specific number of weeks or sessions is required.

We may terminate this agreement with immediate effect on notice to you if you are in breach of the Client agreement (i.e. Stealing or other criminal activities within the facility). In this event, you will not be liable to pay any further automatic continuous Payments, provided such breach is not deemed by us to have occurred primarily to qualify you for a refund.


We will do our best to resolve any disputes over this agreement. If you wish to take court proceedings against us, you must do so within the United Kingdom. Relevant UK law will apply.
